Subject: Implementation Of Act 130 Of 1995 Legislative Session

Act 130 of the 1995 Regular Legislative Session creates an early retirement program for members of the Louisiana State Employees Retirement System. The Act also prohibits refilling positions vacated by persons who retire from the Louisiana State Employees Retirement System from June 12, 1995 through January 1, 1996, except for those positions re-authorized by the Commissioner of Administration and the Director of the Department of State Civil Service.

In order to implement the provisions of the Act, the Department of State Civil Service will freeze all positions vacated by retirement from the Louisiana State Employees Retirement System during the effective period. This action will be taken to prevent filling the positions without the proper authorizations.

Any request for authorization to refill a position frozen as a result of the implementation of this Act must be submitted in writing and addressed to the Commissioner of Administration. The request must include a full justification of the need for the position. Please note that the Act limits the number of positions that can be reinstated to 10% of the total vacated by retirement. Given that limitation, requests for reinstatement of positions will be reviewed very carefully and will be difficult to obtain.
