Subject: Use of GS Levels to Determine Overtime Compensation for Employees in the Protective Services and for the Technical and Skilled Trades Pay Schedules
Issue Date: October 14, 2002
The Civil Service Rules on overtime compensation currently refer to GS and MS levels in determining the types of overtime compensation which can be used. These rules have not yet been modified to include pay schedules other than the GS and MS schedules. Until such time as the overtime rules are revised, please apply the rules using the GS level assigned to these jobs prior to September 23, 2002.
Please remember that nonexempt employees, REGARDLESS OF GS LEVEL must be compensated in accordance with the Fair Labor Standards Act when they actually work over forty hours per week, or over the allowable number of hours for those with special provisions in Section 7 of the Act, such as law enforcement and fire protection jobs.
