Appellant appearing in proper person; Kevin C. Sneesby representing the appellee. Limited to the issues raised in the agency=s Motion for Summary Disposition. THE COMMISSION DISMISSED THE APPEAL AT 9:10 A.M. BECAUSE APPELLANT WAS NOT PRESENT. THE APPELLANT ARRIVED AT 9:15 A.M. AND EXPLAINED HE HAD BEEN DELAYED BY THE WEATHER AND ROAD CONSTRUCTION. THE COMMISSION THEN VACATED ITS ORDER OF DISMISSAL AND ORDERED THE APPEAL RESCHEDULED.

 

3) 9:00 a.m. Public hearing of the appeal of PATRICIA HADLEY vs. DEPARTMENT OF LABOR, (OFFICE OF WORKERS= COMPENSATION), Docket No. S-13304. Duke E. Tilley, Jr. representing appellant; Kim M. Hoffman representing the appellee. THE COMMISSION HEARD THE APPEAL AND TOOK THE CASE UNDER ADVISEMENT.

4) Director=s Report.

1) The Commission received a presentation by Robert Boland relative to the Louisiana Supreme Court Decision in the Department of Agriculture and Forestry vs. Civil Service Commission case.

2) The Commission received a presentation by Lisa Lusk relative to new and revised Pay Rules and the Commission approved their placement on general circular.

5) Consideration of the request from Governor J. Mike Foster, Jr., to allow Andy Kopplin, Governor=s Policy Director, to serve as the Office of Governor=s representative on the Comprehensive Public Training Program=s Policy Board. THE COMMISSION APPROVED THE REQUEST.

6) Employee Opportunity to Address the Commission.

1. Consideration of a proposal to amend Civil Service Rule 8.2 and the Examining Division=s policy concerning the expiration of test grades. (Appearance by Charles R. King.) (SEE ATTACHMENT)

THE COMMISSION CONSIDERED MR. KING=S PROPSAL AS WELL AS COMMENTS FROM ZBIGNIEW CYPEL, DEIDRE ADAMS, NANCY DEWITT, NANCY FLEMING AND BONNIE FULLER OPPOSING THE PROPOSAL. THE COMMISSION DID NOT SUPPORT THE PROPOSAL AND DENIED MR. KING=S REQUEST FOR AN ORDER INITIATING THE RULE MAKING PROCESS.

7) Public hearing to consider the proposed amendments to Civil Service Rules 6.25, 8.10.01, 11.29, and 14.1(c) as they are outlined in General Circular No. 1344. (Appearance by a Representative of the Department of State Civil Service.) AFTER RECEIVING A PRESENTATION BY HERB CANNON AND PAM PERCY, THE COMMISSION ADOPTED THE RULES, WITH AMENDMENTS.

8) Request of the School Employees= Retirement System for authority, under the provisions of Civil Service Rule 4.1(d)2, for ongoing unclassified authority for the position of Chief Investment Officer. (Appearance by a Representative of the School Employees= Retirement System.) THE REQUEST WAS APPROVED BY THE COMMISSION.

9) Request of the Department of Transportation and Development for authority, under the provisions of Civil Service Rule 4.1(d)2, for ongoing unclassified authority for the position of Intelligent Transportation Systems (ITS) Engineer. (Appearance by a Representative of the Department of Transportation and Development.) THE COMMISSION APPROVED THE REQUEST FOR A TWO-YEAR PERIOD.

 10) Request of the Department of Public Safety for authority, under the provisions of Civil Service Rule 6.27(a), to pay overtime at the time and one-half rate for hours worked in excess of forty hours per week, effective January 1, 1999 through December 31, 1999 for Gwendolyn Brashear, Sibyl Guidry and Christine Langlois in the Criminal Records Section. (Appearance by a Representative of the Department of Public Safety.) THE COMMISSION APPROVED THE REQUEST.

11) Request of the Department of Revenue for authority, under the provisions of Civil Service Rule 6.16(c), for individual pay adjustments for twenty-six (26) Revenue Agent 2=s. (Appearance by a Representative of the Department of Revenue.) THE COMMISSION APPROVED THE REQUEST.

12) Consideration of the following requests, under the provisions of Civil Service Rule 6.16(a), for one-time payments in premium pay for attainment of certain certifications /credentials: THE COMMISSION APPROVED ALL OF THE FOLLOWING REQUESTS.

1) DHH-Office of Alcohol and Drug Abuse. $500 for Vicki Cannella for attainment of the Certificate of Supervisory Training through the Comprehensive Public Training Program.

2) Division of Administration. $250 for Richard Hollowell for accreditation as a Certified Insurance Service Representative from the Society of Certified Insurance Service Representatives and $250 for Melissa Harris for attainment of Certified Insurance Counselor from the Society of Certified Insurance Counselors.

3) Department of Corrections. $500 for Judy Martin for attainment of the Certified Public Manager certification through the Comprehensive Public Training Program and $500 each for Judy Martin, Marcella Anders, Katherine Spears, Timothy Hooper, Linda Easter, Karen Ross, Johnny Scott, Kenneth Stewart and Ann Vick, for attainment of the Certificate of Supervisory Training through the Comprehensive Public Training Program.

4) Department of Revenue. $250 for Virginia Burton for attainment of the Certified Government Financial Manager designation through the Association of Government Accountants, and $1000 for Earl J. Millet, Jr., for attainment of the Certified Public Accountant designation through the State Board of CPA=S of Louisiana.

5) Department of Environmental Quality. $1000 each for Clay Stafford and Denise Stafford for their attainment of the Certified Public Accountant designation through the State Board of CPA=s of Louisiana.

13) Consideration of the following requests, under the provisions of Civil Service Rule 6.10(d), for exceptions to the mandatory pay reductions upon demotions: THE COMMISSION APPROVED ALL OF THE FOLLOWING REQUESTS.

1) Department of Wildlife and Fisheries for Andrew Vaughan. He demoted, effective March 8, 1999 from the job of Communications Specialist 2 (GS-14) to the job of Information Systems Applications Programmer 1 (GS-13). This will allow him to demote and retain his current rate of pay at $1742 per month.

2) Department of Wildlife and Fisheries for Lloyd E. Posey. He demoted, effective January 11, 1999 from the job of Wildlife Educator Area Coordinator (GS-17) to the job of Biologist 3 (GS-16). This will allow him to demote and retain his current rate of pay at $2791 per month.

3) Louisiana School for the Visually Impaired for Charles F. Crowder. He demoted, effective February 8, 1999 from the job of Procurement Officer 1 (GS-17) with Lallie Kemp Medical Center, to the job of Purchasing Agent 3 (GS-14) at the Louisiana School for the Visually Impaired. This will allow him to demote and retain his current rate of pay at $2220 per month.

4) Department of Insurance for Marilyn D. White. She demoted, effective March 1, 1999 from the job of Social Services Case Manager/Family Support (GS-15) with the Office of Family Support, to the job of Insurance Compliance Examiner Specialist 1 (GS-12) at the Department of Insurance. This will allow her to demote and retain her current rate of pay at $1874 per month.

5) Department of Transportation and Development for Jacob Broussard. He wishes to demote, effective April 19, 1999 from the job of Engineering Technician Supervisor 2 (GS-17) to the job of Engineering Technician Supervisor 1 (GS-15). This will allow him to demote and retain his current rate of pay at $2777 per month.

6) Department of Transportation and Development for Samuel C. Hoggatt, Jr.. He demoted, effective February 15, 1999 from the job of Mobile Equipment Operator 2 (GS-10) to the job of Engineer Technician 1 (GS-8). This will allow him to demote and retain his current rate of pay at $1609 per month.

7) Department of Transportation and Development for Brian Edmand Kemp. He wishes to demote from the job of Highway Foreman 2(GS-16) to the job of Sign/Striping Coordinator (GS-15). This will allow him to demote and retain his current rate of pay at $2616 per month.

8) Department of Corrections for Annette Viator. She voluntarily demoted, effective March 10, 1999 from the job of Attorney-General Counsel 2 (GS-27) to the job of Attorney-Deputy General Counsel 2 (GS-26). This will allow her pay to be set at the maximum of the GS-26 range, $6227 per month.

9) Department of Public Safety for Tammy Poirrier. She demoted, effective February 16, 1999 from the job of Administrative Secretary (GS-11) to the job of Computer Support Specialist 1 (GS-10). This will allow her to demote and retain her current rate of pay at $2059 per month.

10) Department of Labor, Office of Workforce Development, for Rose L. Harrell. She wishes to demote from the job of Employment Security Operations Analyst 2 (GS-18) to the job of Employment Security Operations Analyst 1 (GS-17). This will allow her pay to be set at the range maximum for the lower level position, allowing her to draw a monthly salary of $3387 per month.

11) DHH - Region IX Administration for Carolyn Saragusa.. She demoted, effective January 25, 1999 from the job of Support Enforcement Specialist 2 (GS-14) at the Office of Family Support, to the job of Eligibility Examiner 2 (GS-13) in the Bureau of Health Services Financing in Region IX within DHH. This will allow her pay to raise from $2442 to $2584, the maximum of the GS-13 pay range.

12) Department of Health and Hospitals for Paula McDonner. She demoted from the job of Accountant 3 (GS-17) to the job of Information Systems Applications Programmer 1 (GS-13) both in the Office of the Secretary/Office of Management and Finance within DHH, effective March 22, 1999. This will allow her to demote and retain her current rate of pay at $2537 per month.

13) Department of Transportation and Development for Janis L. Coleman. She demoted effective March 15, 1999 from the job of Case Worker Assistant (GS-9) to the job of Clerk 4 (GS-8). This will allow her to demote and retain her current rate of pay at $1194 per month.

14) Request of Louisiana State University Medical Center at Shreveport for authority, under the provisions of Civil Service Rule 6.10(d), for permanent exceptions to the mandatory pay reduction upon voluntary demotions for Linda S. Kelly and Rosie F. Roberson, effective January 25, 1999, from their respective jobs of Registered Nurse Supervisor 1 (MS-64) to the jobs of Registered Nurse 3 (MS-63) within the Louisiana State University Medical Center at Shreveport. This request will allow both employees permanently to retain their salary of $3858 per month upon their demotions. THE COMMISSION APPROVED THE REQUEST.

15) Request of LSU, Health Care Services Division to withdraw the unlodged appeal to the Court of Appeal in Michelle Thompson vs. LSU Health Care Services Division, E. A. Conway Medical Center, Docket No. S-11841. (Appearance by Ms. Laura Holmes.) THE COMMISSION APPROVED THE REQUEST.

16) Request from LSUMCL/Mental Health Services in New Orleans to allow for the conversion of premium pay into base pay for Registered Nurses, retroactive to the implementation of the structure adjustment to the Medical Pay Schedule on January 1, 1999. THE COMMISSION APPROVED THE REQUEST.

17) Request from the Department of Environmental Quality for approval under the provisions of Civil Service Rule 14.1(p), to appoint 3 unclassified employees to the classified service in the positions of Environmental Division Administrator (GS-28). (Appearance by a Representative of the Department of Environmental Quality.) THE COMMISSION APPROVED THE REQUEST.

18) Request of the Department of Natural Resources for authority, under the provisions of Civil Service Rule 6.16.1, to establish a policy for a Rewards and Recognition program to be effective March 1, 1999 to reward those employees who are instrumental in the Department=s safety program. (Appearance by a Representative of the Department of Natural Resources.) THE COMMISSION APPROVED THE REQUEST.

4) Request of Nicholls State University for authority, under the provisions of Civil Service Rule 6.16(d), to establish an Incentive Awards Program for the University, consisting of two annual awards from two private civic organizations. THE REQUEST WAS APPROVED BY THE COMMISSION.

5) Request of Nicholls State University for authority, under the provisions of Civil Service Rule 6.16.1, to establish a policy for a Rewards and Recognition program, retroactive to July 1, 1998, to reward employees for service to the University. THE REQUEST WAS APPROVED BY THE COMMISSION.

6) Request of the Office of State Parks, Department of Culture, Recreation and Tourism, for authority, under the provisions of Civil Service Rule 6.3.1, for housing allowances of $200 per month for Park Managers at locations where no housing is available on site. THE REQUEST WAS APPROVED BY THE COMMISSION.

7) General Business No. 11 - Addendum to the request by the Department of Revenue, under the provisions of Civil Service Rule 6.16(c), to add Mr. Alexander Osemwingie to the original list of Revenue Agents 2 for individual pay adjustments. THE REQUEST WAS APPROVED BY THE COMMISSION.

8) General Business No. 13 - Addendum to the requests, under the provisions of Civil Service Rule 6.10(d), for exceptions to the mandatory pay reductions upon demotions: THE REQUEST WAS APPROVED BY THE COMMISSION.

13) Division of Administration for Michael Ristroph. He transferred and voluntarily demoted from the job of Prison Enterprises Industries Director (GS-20) at the Department of Public Safety and Corrections to the job of Program Compliance Office Supervisor (GS-19) with the Louisiana Property Assistance Agency at the Division of Administration. This will allow him to demote and retain his current rate of pay at $3198 per month.
